1. Introduction

Welcome to Halaalish.com, South Africa’s trusted Halaal marketplace. These Terms and Conditions govern your registration and use of the Halaalish.com Vendor Portal.

By registering as a vendor, you agree to be legally bound by these terms and all applicable South African laws, including the Electronic Communications and Transactions Act (ECTA), the Consumer Protection Act (CPA), and the Protection of Personal Information Act (POPIA).

2. Definitions

• "Halaalish" / "We" / "Us" / "Our": Halaalish (PTY) Ltd.
• "Vendor" / "You" / "Your": Any individual or business registered to list or sell products on Halaalish.com.
• "Platform": The website Halaalish.com and related services provided by Halaalish.

3. Vendor Eligibility

• You must be 18 years or older or a registered business entity.
• You must have legal capacity to enter into a binding agreement.
• You must provide accurate and verifiable information.
• You must comply with South African law.
• You must provide proof of Halaal certification where applicable.

4. Vendor Obligations

As a vendor, you agree to:

• Only list and sell Halaal-compliant, lawful products.
• Ensure all product information is accurate and up to date.
• Fulfill orders promptly and professionally.
• Respect customer rights under the Consumer Protection Act.
• Protect personal data in compliance with POPIA.
• Respond to customer complaints promptly.
• Report suspicious activity immediately.

5. Prohibited Products and Conduct

• Non-Halaal, expired, counterfeit, or illegal goods.
• Fraudulent or misleading practices.
• Price or review manipulation.
• IP rights infringement.
• Collection or misuse of customer data.
• Hate speech or unlawful promotion.

6. Fees and Payment

• We may charge commissions or service fees as communicated to you.
• Payments are processed securely via approved payment gateways.
• Vendors are responsible for any applicable taxes, including VAT.

7. Intellectual Property

All Halaalish branding and platform content remains the property of Halaalish (PTY) Ltd. Vendors grant us a royalty-free, non-exclusive license to use and promote their product content on the platform and associated media.

8. Account Suspension or Termination

We reserve the right to suspend or terminate your account for violations of these terms, illegal activity, or actions harmful to the platform’s integrity or reputation.

9. Limitation of Liability

To the maximum extent allowed by South African law, Halaalish shall not be liable for indirect, incidental, or consequential damages, including delivery failures or third-party disputes.

10. Indemnification

You agree to indemnify and hold Halaalish, its staff, and partners harmless from any claims, damages, or legal fees arising from your breach of these terms or misuse of the platform.

11. Privacy and Data Protection

12. Governing Law and Dispute Resolution

These terms are governed by South African law. Disputes will first be mediated, and if unresolved, will fall under the jurisdiction of the Gauteng High Court, Johannesburg.
