Vendor Terms and Conditions

Effective Date: 02 April 2025

These Terms and Conditions (“Terms”) govern your use of the Halaalish.com website and services (“Platform”). By registering, accessing, or using the Platform, you agree to comply with these Terms.

1. Who We Are

Halaalish.com is a South African-based digital marketplace that connects consumers with Halaal-certified and Muslim-owned vendors across various categories. Our mission is to support and promote Halaal commerce globally through digital innovation, ethical trade, and verified product listings.

2. Vendor Registration & Usage

  • Vendor registration is free.

  • No monthly subscription fees are charged.

  • Vendors agree to pay:

    • A 10% success fee on every successful order.

    • A 3% debit and credit card transaction fee per processed order.

    • No transaction fee when using ShariaCoin via MetaMask Wallet.

    • A R10-R20 withdrawal fee on every payout transaction.

  • Vendors are paid out weekly (Friday to Friday).

  • Vendors are responsible for updating their:

    • Product prices and descriptions regularly.

    • Shop details, including collection addresses.

3. Vendor Responsibilities

  • All warranties, guarantees, and product issues are the responsibility of the individual vendor.

  • After-sales queries and customer service must be handled directly by the vendor.

  • Vendors must maintain accurate product listings and store policies, including refund and return terms.

  • Vendors must ensure that all products listed, particularly in food and beverage categories, are Halaal and free from Haraam ingredients or associations.

4. Account Suspension & Termination

Halaalish.com reserves the right to suspend or terminate vendor accounts for:

  • Receiving more than three complaints regarding poor service or defective products.

  • Providing false or misleading information.

  • Selling Haraam products.

  • Remaining inactive for a period exceeding three months.

5. Platform Limitations & Liability

  • Halaalish.com acts as a facilitator and does not manufacture, stock, or ship products.

  • Halaalish.com is not responsible for any vendor’s failure to fulfil orders, meet delivery timelines, or product quality.

  • Disputes between buyers and vendors must be resolved directly between the parties.

6. Payments

  • Halaalish.com processes payments securely through third-party processors.

  • Crypto payments via MetaMask (using ShariaCoin) carry no processing fees.

  • All vendors must ensure their banking details are updated to avoid payment delays.

7. Intellectual Property

All content on Halaalish.com (logos, product data, images, etc.) remains the property of Halaalish.com or the respective vendors. Unauthorized use, reproduction, or redistribution is prohibited.

8. Data Protection & Privacy

Our platform adheres to the Protection of Personal Information Act (POPIA), the Consumer Protection Act (CPA), and the Electronic Communications and Transactions Act (ECTA). For more details, please refer to our Privacy Policy.

9. Modifications to Terms

We may revise these Terms at any time. Continued use of the Platform after updates implies acceptance of the revised Terms. We encourage vendors and users to check this page regularly.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes arising from these Terms shall be subject to the exclusive jurisdiction of South African courts.
